On Friday, May 4, 2012 at approximately 5:00 p.m., Lucious Smith, 45 (B/M, DOB 1/1/67), of Lakeland, turned himself into the Lakeland Police Department. Smith was charged with Armed Burglary and Aggravated Battery and transported to the Polk County Jail.

The original release indicated this incident was a robbery. Upon further investigation, the case is being investigated as an assault and battery.
The suspect in this case entered the restaurant to order food. Apparently the suspect had waited for some time and was not served. The suspect was subsequently asked by the manager if he had been waited on and the suspect advised the manger that he had not. The suspect then became enraged and belligerent and told the manager that the same thing happened to him on the previous day. The suspect demanded the corporate number and was provided it by the manager. The suspect then threw down the paper that contained the number and left the store.
The suspect returned to the store approximately twenty minutes later with a baseball bat, at which time, he jumped the counter and accosted the manger. The suspect then struck the manager (victim) twice with the bat. The suspect then stated, “all I wanted was some (explicative) food” and then left the store. The victim sustained significant bruising to his ribs as a result of the attack.

On April 22, 2012 at approximately 10:30 p.m., Lakeland Police responded to the McDonald’s restaurant located at 715 E. Memorial Boulevard in reference to a robbery. Upon arrival officers spoke with witnesses, who stated the suspect entered the restaurant and jumped the counter, demanding food. During the incident, the manager was struck in the ribs with a baseball bat. The manager was transported to Lakeland Regional Medical Center with non-life threatening injuries.
Officers are on scene, interviewing witnesses. No suspect is in custody. The investigation is ongoing. No further information is available at this time.
